The content of this book thoroughly discusses the principles of Islamic commercial law which provide the foundation for the instruments of Islamic financial transactions. It begins with historical background and theoretical framework of Shariah rulings, its sources, scope, components, principles and salient features. It will also discuss the prohibited elements in Islamic commercial law which could render all transactions void and null, namely riba, gharar and maysir, and how they might occur in modern transactions. The main focus of this book is dedicated to the theory of contracts in Islamic commercial law. This includes the fundamental elements of valid contracts, their requirements and regulating legal maxims as well as their applications in the modern Islamic financial services. The rest of the book is devoted to important contracts in Islamic commercial law including sales, leasing, partnership and other supporting contracts. The discussion of these contracts will focus on the fundamental elements, requirements and prohibitions as well as illustrations on their modern applications as financial instruments.
